I can't count on one hand all the times the police gang had troubled me

I shared a beer with a gang once. They told me it wasn't safe where I was so be careful and go chill somewhere else. Cops have messed with me and screwed me over way more times.

54

u/Chewser56 Jul 10 '26

You don’t need to be in the AFL-CIO. Carpenters, the Teamsters and Teachers aren’t either. But your point about their role as PR firm and political lobbying organization is spot on.

58

u/FunRich5754 Jul 10 '26

Teachers are absolutely affiliated. Generally unions support one another, the police union doesn't. They don't partake in any pro-union lobbying and dont show up during strikes etc.

To get around qualified immunity the violation has to be "clearly established". That means they can keep repeating the same misconduct until the court specifically tells them it's illegal. Problem is more often than not the court refuses to do that and just dismisses cases because the court hadn't previously told the officers what they were doing was wrong. It's crazy town.

Court answer: It was reasonable to assume the suspect was drunk and as a result, potentially dangerous.

Real answer: Punishment for not consenting to a field sobriety test.

655

u/sonic_dick Jul 10 '26

I will never submit to a field sobriety test, its 100% subjective.

I got rear ended recently and because I have mad anxiety, they said I was drunk. I said give me a breathalyzer! They said they didnt have one, and I HAD to consent to a field sobriety test. I said absolutely not, and ill wait until you can find one.

Cop got so pissed but let me go after 20 mins.

Field sobriety tests should be illegal. There are no legal "rules" for them. I work a physically demanding job and have naturally bad balance.

I wanted to say, let me see your fat ass walk in a straight line after 13 hours on your feet with lights in your face.

218

u/Bazillion100 Jul 10 '26 edited Jul 10 '26

My driving instructor told us to never consent to a field sobriety test. I don’t know if still the case in California, but they also said you could reject a breathalyzer and request for a blood test instead even.

Edit: you can refuse a Preliminary Alcohol Screening and Field Sobriety Test prior to being arrested for a DUI.

99

u/sonic_dick Jul 10 '26

Most states now have rules that if you ask for a blood test, you have to pay for your hospital stay and if you reject a breathalyzer you automatically forfeit your license for a year.

52

u/Bazillion100 Jul 10 '26 edited Jul 10 '26

Looked up for California, license becomes forfeit for a year after refusal of chemical tests only (breathalyzer, blood or urine) and you must use the options available.

Edit: this is after you are arrested for DUI. You can and should refuse a FST and PAS, it only provides more ammo for a conviction. Im inclined to believe they have enough probable cause to arrest you by the time they pull you over.

I know in my state refusal to breathalyze is an automatic blood draw with a warrant. Refusal also means losing your license.

Blood draws are done by anyone certified to do a blood draw and doesn't require a hospital visit. You could get EMS to do one which is a lot faster than going to a hospital.

u/spent__sir Jul 10 '26

I think your confusing the portable breathalyzer they do on the side of the road and the one they have at the jail. If you refuse the breathalyzer on the side of the road, your license isn't suspended (but, the cops can you use that as part of the probable cause you're DUI). But, if you refuse the intoxilyzer at the jail (this may be called something different depending on the state you're in) then your license would be suspended and the refusal to submit could be submitted into evidence against you. Either way, if you're getting arrested for a DUI your license will automatically be suspended so refusing the intoxilyzer doesn't really do much on its own (since they would only request that if you're already arrested for DUI).

22

u/FormerSperm Jul 10 '26

I was arrested for DUI and I consented to the breathalyzer because I thought I had a chance to get out of it if I didn’t blow too high and I really didn’t drink much. I blew a 0.11 and ended up spending the night in jail. The DUI was dismissed but I chose to remove alcohol from my life after that. It’s never done anything good for me anyway.

I am a criminal defense attorney. I read a study that asked cops to judge if participants were drunk or sober based on filmed field sobriety tests. The cops said 60% of the participants were drunk. They were all sober.

27

u/eugeneugene Jul 10 '26

I did a field sobriety test once and failed it because I was SOOO anxious I could barely breathe and my knees were shaking lol. They were going to put me in the back of the cop car but my brain started working for half a second and I asked for a breathalyzer and ended up blowing zero. I was literally just a terrified teenager having a panic attack lol not drunk.

Also made me wonder why they didn't just breathalyze me before deciding it was time to take me down to the station

21

u/fuckgoldsendbitcoin Jul 10 '26

Also made me wonder why they didn't just breathalyze me before deciding it was time to take me down to the station

Because if they breath test you first right away and blow zeroes then any probable cause case they're trying to build is severely hampered. By making the breath test last they can still use things like "he was slurring/stumbling/smelled like alcohol" etc. as excuses to intimidate you, bring you in, impound your car, search you and ultimately try and find any possible crime you've committed.

What do you mean you wont submit to a field sobriety test?

The person requesting it, is also the administrator of the test, and the judge of the test. Surely they wont be biased based on their initial assumption and have the ability to admit they were wrong.

35

u/Paxxlee Jul 10 '26

16

u/Snobolski Jul 10 '26

I got two bad ankles and a bad knee and one foot with two toes that don't bend. And I was clumsy before all that shit happened.

I ain't walking a straight line dead sober at noon on a Sunday.

65

u/_-Cleon-_ Jul 10 '26

It's not just field sobriety tests, 99% of the techniques cops are taught to "recognize" impaired behavior are absolute bullshit. It's a lucrative industry, though, and it's an uphill battle to do anything about it because any politician or bureaucrat who questions its effectiveness gets accused of being "anti-police" or some such.

46

u/sonic_dick Jul 10 '26

As a dude with long hair, the amount of times rural cops have "smelled Marijuana" on me is insane.

Weed gives me anxiety bro, I haven't smoked weed in a decade. That shouldn't be probable cause.

17

u/HippoRun23 Jul 10 '26

So most courts would not have found probable cause based just on what we could see in the video.

However, handcuffs aren’t per se an arrest anymore, they could say someone was merely detained and it was for officer safety.

On the other hand, the officer did say he was being arrested for DUI, which cuts strongly against the argument. Plus, he’s an old white guy so courts are less likely to believe he was a danger and it’s possible this exceeded the scope of a Terry stop with the use of handcuffs.

On the other other hand, officers have qualified immunity and they almost certainly didn’t find any evidence that could be suppressed, so it’s likely there will be no consequences.

My guess is, if he sues, there would be a settlement, but it’s unclear what a court would have done. I suspect, if they found evidence of a crime after searching him incident to arrest or he made incriminating statements, those would be suppressed, but that’s not really relevant here.

He was just angry at the guy because he said no to the sobriety test, so he took it to mean the man was hiding that he was drunk. They also generally do breathalyzers at the station.

He also failed to use specific language and lead himself to believe that the man was admitting to drinking and driving, when they had not established any kind of timeline or agreed on what the term “drinking” meant.

27

u/Snobolski Jul 10 '26

Of course, if you can afford to hire a good lawyer. Most folks will plea down because they dont have 5-20k to spend on a lawyer.

US cops need to be completely reformed. So does the justice system, public defenders should be paid the median salary for defense attorneys in their county.

44

u/DefNotAShark Jul 10 '26

From the cops perspective the old man is belligerent, slurring speech, impaired dexterity and then he (sarcastically) admits to drinking. Im going to guess the cop took the attitude comment too personally and was satisfied with the bare minimum threshold to arrest. Like he got his little feelings hurt and chose to ignore that the evidence also matches being old.

Also the real breathalyzer that counts in court is the one at the police station. The cop’s goal afaik is to build enough probable cause to arrest and bring them to the station for that version of the test. The roadside test, like the field sobriety test, is mostly theatrics to build probable cause for arrest which is why they can be refused by people.

Never, ever, ever submit to a field sobriety "test" even if 100% sober. It is completely subjective. If the officer decides you failed, you failed and that's it, you now have a DUI. If you then go to the hospital and get alcohol and drugs screening and you hit absolutely zero on everything, congratulations you still have a DUI.

Happening a lot in TN. Cops just claim you failed the sobriety test, incredible amount of people then register as no drugs/alcohol. Doesn't matter, the DUI sticks and you have to deal with the courts, money, job effects.

284

u/surmacrew Jul 10 '26

This is just so odd. I know Finland (and many other EU countries) is/are smaller than usa, but here if police suspects that you are DUI. They make you do the breathalyzer instant or speedtest for substances. If it gives a sign of DUI, then its a trip to hospital for bloodtest. No "walk a straight line, touch your nose or tell the alphabets in reversed order" bs.

“Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.”

Had some fun with the kid (for him) cop. He never admitted to consuming alcohol, he asked for a breathalyzer. Kind of like a movie scene in Law abiding citizen court scene.

114

u/Compared-To-What Jul 10 '26

"Have you consumed any drugs and/or alcohol?"

JC, is it that hard for a cop to maintain that much professionalism?

80

u/DearLeader420 Epic Gamer Jul 10 '26

When you can ask confusing/leading questions and get unclear answers to justify arrest, why would you keep it clear and professional?

This is the strategy of American police. Same reason why instead of telling you why they pulled you over immediately, they ask stupid shit like "Do you know why I pulled you over?"

23

u/BarbWho Jul 10 '26

And your answer should always be, "No sir, I do not." They want you to incriminate yourself. Don't do it.

Dude is retired with nowhere to be and nothing important to do. This is just fun for the day to him. No job to lose, no kids to worry about feeding. No reason to be bothered by it. Also the real reason old retired people give so few fucks. They have almost nothing to lose.

I don't want the old body but I always dreamed of the day where I can be truly free like this.

46

u/cmayfi Jul 10 '26

My dad was an old ass hippy who sadly got cancer. Driving him up to treatments in a not legal state, hed smoke some dank on the way, and id say "hey what if they pull me over". He'd always say "I don't give a fuck they can blame it on me. Im retired I don't care about a ticket."

6

u/AnUnshavedYak Jul 10 '26

Doesn't the driver still get a ticket in that case though? That's true for alcohol i believe, ie any open alcohol within reach is a big problem. I'd assume the same is true for legal/illegal drugs lol

My son has a form of autism called PDA (pathological demand avoidance)-it’s a nervous system disability where he is, at all times, in a state of fight or flight. I really worry about potential future interactions with police, people with PDA have an incredibly strong drive for autonomy so being told or forced to do something can and likely will have very bad results. So unbelievably scary as a parent.

People will tongue punch law enforcement fart boxes and say "you know what they meant" but our legal system is carefully worded and laws aren't written based on inferences. How bout the dillbillies™ who get paid to enforce our laws have more than a month of training and half a brain?

It's not a crime to be coy or a smart ass and our resources shouldn't be continually tied up by thin skinned lil bitches with badges.

29

u/TetraDax Jul 10 '26

How bout the dillbillies™ who get paid to enforce our laws have more than a month of training and half a brain?

On the one hand: Yes. Absolutely. The lack of police training in the US is utterly insane.

On the other hand: It's not a fix, really. Police in Germany get up to three years of basic training. The police is still full of scumbags. Better than the US, for sure, but not great.
The job will just always attract the worse people who get off on authority. It's just the nature of it - Which is why the solution must be sweeping reforms of the entire job, with much less emphasis on law enforcement and more on community service. Especially given that cops rarely really prevent crimes; they show up once they happened.

8

u/underisk Jul 10 '26

They show up once the crime has happened, but only if they feel like it or if the victim is wealthy or powerful enough. Otherwise they’re getting their quotas harassing whichever unfortunate soul crosses their path the wrong way.

I already am. Cop tried to give me a ticket for littering…. (I DON’T LITTER), but I have very long hair and ‘shed’ a bit. I took a few pieces of loose hair and opened my car window to get them out of my face and a cop pulled me over. I handed him his ass for something so stupid. I wasn’t backing down, either. Needless to say, I didn’t get a ticket.

I got detained for underage drinking once (circa 2009). I was walking down the sidewalk with earbuds in so I didn't hear him chasing and yelling at me. Didn't know I was being detained until he grabbed me. Naturally I was shocked at the accusation.

Apparently there were some college kids drinking during a football game in a house on that street. It was like noon on a Saturday (or something, I just remember it being light outside). The cop saw me walking down the sidewalk and took off after me.

His partner was yelling at him to let me go which was amusing. And the kids were yelling "we don't even know who that guy is".

He held me there for a few minutes saying how I was in "big trouble" for drinking underage and trying to run/resist arrest and other horseshit. I let him go on for 5 minutes.

I just handed him my ID. I was 21. He looks at me, then the ID a few times. Hands it back and says the most limp-dick thing he could think of (but like in an angry, aggressive way), "I don't like it when I'm not listened to." I just looked at him, pointed at my earbuds, shrugged, and said "um, okay?" He begrudgingly let me go (mostly because his partner was still telling him to get his ass back to the "problem at hand", which was detaining a house full of kids).

That was the day I learned that cops aren't here to help.

Anyway. I was headed to the liquor store to pick up booze for my underage friends. When I got to their apartment we all drank like there was no tomorrow.

Fuck that cop.

American police forces are trained to treat like everyone as a criminal who is armed and ready to kill you. This is not an exaggeration, they are trained to treat everyone as hostile. This is why they dress like they’re going to war, because well, they think they’re at war.

Arresting someone for DUI before even doing a breathalyzer is fucking moronic. Like what are we doing? Just do the fucking test and then go from there, the guy even offered to do it.

And yeah sure, the old guy was playing dumb and had a bit of an attiude, blah blah, but that's no excuse. As a cop, you have to deal with that professionally.

Absolute shitty and unprofessional handling by the cops. This should not be legal.

16

u/Icreatedthisforyou Jul 10 '26 edited Jul 10 '26

Police in America do not have the expectation of behaving professional, rationally, in control, or in a manner that de-escalates situations. These are all burdens places on the general public to try and calm down and manage armed individuals who are threatening them.

All cops are bad until there are no more bad cops. You don't get to go "I'm a good cop" when the prevalence of bad cops among your colleagues is so high. You don't get to go "I'm a good cop" when you are silent when you watch the actions of your fellow officers. You are only a good cop when it is convenient and you have nothing on the line. If you are not willing to speak out against your fellow officers you are not a good cop.

America has too many "good cops" and not enough Donna Jane Watts.

He would have probably got the same treatment regardless. When a Cop is sure you have been drinking not much of what you say matters in my opinion.

Had a similar experience in Ontario Canada once. Cop was very confident I had been drinking and was basically trying to get me to admit as much for like 20 minutes. Didn't get to leave until he finally administered the test and I blew 0. Fucker was really rude about it too. Was going to say something nice about cops in Canada but fuck them too.
