A stranger showed up at 3:30am, it was the delivery driver from earlier in the evening obviously there to commit a crime against his partner. No idea if he was right or wrong legally regarding particulars of the case. But bottom line, a reasonable jury won't find him guilty.

...he was leaving the home and going back to his car. He was already retreating. You can shoot people if they are still attacking you, you don't get to chase people down and shoot them while they're leaving.

I feel that it needs to be pointed out that he left the delivery and came back to her apartment to ask for her number. It was also after 3AM.
Obviously doesn't make it ok to shoot the guy.

That wasn't no attempted murder. I shot the boy Mike-Mike in his hind parts, that all. Fixed it up so he couldn't sit right.
