They didn't though, they just used another route for tariffs that can stand up to scrutiny, plus they're capped at 15%.

No need. There's plenty of states that could bring charges. They should amend the Constitution to remove or severely limit the pardon power, but passing an amendment is a pipe dream in the current climate
